Q: I was stopped for going 41 mph in a 35 mph zone and I got surprise K9 searched. I also never went faster than 39 mph.

The cop asked for my license and registration after telling me he stopped me for speeding and that I was driving 41 mph in a 35 mph zone. I knew he was bullshitting and never even hit me with a speed gun because I have a radar. He also asked if he could search my vehicle and asked me a million... View More

Based on your description, there are several potential issues with the traffic stop and search:

1. Pretext for the stop: If you were not actually speeding (as your radar indicated), the officer may have used the alleged speeding violation as a pretext to stop you and investigate for drugs....

This is a good time to learn about Idaho and the 4th Amendment to the US Constitution. A police officer has been endowed with a limited amount of discretion. He is not required to ticket someone for the "reasonable suspicion" reason that he pulled him over for, but he should if he wants... View More

Most states respect other states' laws, as long as judgments were rendered with die process. VA issued you a valid DL for 5 minutes. That's actually a much shorter time than I would have guessed, with high speed computers and other means of transmission. Once VA discovered your DL status... View More

Q: I was pulled over for non working break light, but they work and were on during stop.

Said reason for traffic stop was bad tail light. Searched my vehicle and arrested me for possession. Police officer lied. My break/tail lights weren't out. They work just as they should. Can I get my possession case dismissed on ground for unlawful traffic stop?

Your questions raise more questions. What time of the day? Night? was the stop? Were you driving in a "bad neighborhood?" Was a drug dog used? From the time your car got turned off after the stop, how long did it take the drug dog to get there?

If NO dog was used, try to...

He said I was going 61 in a 40 in the hills, I passed him on a blind corner as I was slowing down coming around the corner. As I pull over, I grab my wallet from the center cup holder for my license. You can answer that question yourself by referring to the code sections for speeding as well as reckless driving. Speeding is self-evident. However, "reckless driving" is defined as: "carelessly and heedlessly or without due caution and circumspection, and at a speed or in a... View More

An Idaho attorney would know this best, but your post remains open for two weeks. As a general matter, you could check the signage. As a GENERAL matter, bus lanes sometimes have times during which the restrictions to regular vehicles apply. Good luck

Idaho doesn't have such a statute. An "assault" is the reasonable fear of a "battery." A "battery" is an "unlawful touching." If you touch another person against their will, you may be charged with "battery." If you use an automobile to... View More

Pleading guilty to not having insurance WILL suspend your DL. But all you need to do to get permission to drive is prove that you now have insurance. The plates is an infraction and is under $100 fine. Good luck!

Q: Need understanding of "it shall be painted a color other than..." - does that mean every trace of original color gone?

Schoolbus-to-RV/Van conversion. ID and IA laws say, "...shall be painted a color other than national school bus glossy yellow...". Does that mean every TRACE of yellow covered, or would it be legal to paint the bulk of the bus, say, blue (e.g., below the windows)? Ref:... View More

As I read the statute you refer to I think it depends on HOW different your paint job looks from the original yellow. Every cop has discretion to or not to make a big deal, not to write a ticket, or to write one and even if you're technically correct, you'll still be sorry if you get a... View More
